In a Wednesday, Feb. 5, 2014 file photo, Duke Energy engineers and contractors survey the site of a coal ash spill at the Dan River Power Plant in Eden, N.C. The federal, North Carolina and Virginia governments want a judge to declare Charlotte-based Duke Energy liable for environmental damage from a leak five years ago that left miles of a river shared by the two states coated in hazardous coal ash. Government lawyers on Thursday, July 18, 2019 sought to have Duke Energy declared responsible for harming fish, birds, amphibians and the bottom of the Dan River.

In this Nov. 14, 2017, file photo, crews with Duke Energy continue to remove coal ash from the old coal ponds at the Sutton Plant, in Wilmington, N.C. A toxic stew of coal ash has spilled repeatedly and apparently unnoticed from storage pits at a Wilmington power plant into an adjoining lake, according to a Duke University scientist who said Monday, June 3, 2019, that flooding last September from Hurricane Florence was only the latest example. The concentrations of lead, cobalt and other heavy metals detected in the sediment of the lake next to Duke Energy Corp.'s Sutton power plant equal or exceed the pollution from the country's worst coal-ash spill in Kingston, Tennessee, in 2008, geochemistry and water quality professor Avner Vengosh said in the research published last month.

A federal jury decided Friday, Aug. 3, 2018, that the world's largest pork producer should pay $473.5 million to neighbors of three North Carolina industrial-scale hog farms for unreasonable nuisances they suffered from odors, flies and rumbling trucks. The jury found that Smithfield Foods owes compensation to 16 neighbors who complained in their lawsuit that the company failed to stop “the obnoxious, recurrent odors and other causes of nuisance” resulting from closely packed hogs, which “generate many times more sewage than entire towns.”
