One customer is taking issue with the way Kellogg Co. is marketing its strawberry flavored Pop-Tarts.
Anita Harris has filed a $5-million-dollar lawsuit alleging the name "Frosted Strawberry Toaster Pastries," is "false, misleading, and deceptive."
According to CNN, the class action suit also claims the ingredients in the product indicate the product is healthier than it is.
She also suggests that the strawberry content is diluted by the product’s “non-strawberry fruit ingredients" including pears and apple.
CNN points out that the product's ingredients list says Pop-Tarts contain "2% or less of wheat starch, salt, dried strawberries, dried pears and dried apples."
Edgar Dworsky, consumer lawyer, told the news outlet that “food product labeling cases are hot now,” and pointed to other lawsuits with similar context.
These include allegations that Subway’s tuna contains no fish, or that Honey Bunches of Oats features very little honey.
Says Dworsky, “How they ultimately turn out is a toss of a coin."
